COOKIE POLICY

1. Introduction

1.1 Data Controller. As the Data Controller, Coesia S.p.A. (“Coesia” or the “Company”), Tax Code and 
VAT no. 02221441203, with registered office at Via Battindarno 91, 40133, Bologna, Italy, 
e-mail: privacy@coesia.com, publishes this Cookie Policy in compliance with the legal requirement to inform Data Subjects about the processing of their Personal Data through cookies and other tracking tools used on this Website. 

1.3 Regulatory references. This Cookie Policy has been prepared in compliance with Regulation (EU) 2016/679 (“GDPR”) and the Italian regulatory framework specified in the Code for the protection of personal data, as well as with the latest measures adopted by the Italian Data Protection Authority (“Garante per la protezione dei dati personali”) in relation to cookies. 

1.4 Amendments. This Cookie Policy may be amended or updated periodically for various reasons, including - by mere way of example - changes in the applicable Italian and European regulations and in corporate requirements. New versions of the Cookie Policy will be published on the Website when amendments are made. These new versions will become valid and effective on their publication date.

1.5 Other references. This Cookie Policy supplements the information about the processing of Data Subjects’ Personal Data contained in the Privacy Policy and all other policies published on the Website.

2. What are cookies?

2.1 General information about cookies. Cookies are small text files created by automated procedures when the Data Subject browses the Website. They are sent to and stored on the device of the Data Subject during that process, and returned during subsequent visits to and uses of the Website. Cookies may be sent directly from the Website visited (“first-party cookies”) or, via the Website visited, from websites (or web servers) managed by external operators known as “third parties”.
These websites use cookies to store information on the user’s device, including “personal data” as defined in the personal data protection regulations (e.g. IP address, a unique code recorded on the user's device, the e-mail address of the user etc.).
Cookies are needed to administer the Website and enable the Data Controller to provide requested services and improve the browsing experience of Data Subjects. Cookies differ, depending on their type and purpose, as described below.

3. Types of cookies used by Coesia and their purpose 

As described further in the table found at this link, the Website uses:

a. technical cookies for activities needed for the functioning of the Website and its use by Data Subjects. Technical cookies are essential, so that Data Subjects can visit the Website and the functions expressly requested by them can be executed;

b. functional cookies that enable Data Subjects to use certain Website functions in accordance with their preferences, e.g. without limitation, to fill in forms, to save the names of Data Subjects and their preferred language, to create settings for the text displayed, character size etc.

c. analytical cookies to generate aggregated statistical reports used to assess the effectiveness of the Website, measure its traffic, improve it and measure the social media effectiveness of marketing campaigns;

d. profiling cookies to create profiles of Data Subjects and their consumption habits. These are used to send advertising that is consistent with the preferences shown by Data Subjects when browsing the Website and interacting with its functions.

4. Legal basis for the processing of personal data

The processing of personal data through the use of strictly necessary technical cookies, as indicated in the table, is necessary to ensure the proper technical functioning of the Website that users request to access to, on the basis of Art. 6, par. 1, let. b) GDPR. On the other hand, preference, analytical and profiling cookies are only used on the basis of the user’s consent, pursuant to Art. 6, par. 1, let. a) GDPR and Art. 122 of Decree no. 196/2003 (“Italian Code for the protection of personal data”).

5. Duration of cookies

The personal data collected through cookies and other tracking tools is processed for the period of time indicated for each cookie or tool in the table found at this link (“Cookie Declaration”). On expiry of the retention period, the related Personal Data is erased or anonymised, unless it is needed for criminal investigations by the judiciary.

6. Disabling cookies Users can decide not to use cookies by choosing one of the following options:

7. Recipients of personal data

Personal data may be processed by Company personnel who have been duly authorised and expressly designated to process personal data, as well as - where applicable - by the providers of hosting servers and those companies that maintain the IT systems and develop the Website that have been appointed as Data Processors.

The personal data collected and processed using cookies may also be made known to the providers of third-party cookies and tracking tools, as indicated in the table.

8. Rights of Data Subjects

Without prejudice to the restrictions placed on the exercise of the rights of Data Subjects by Arts. 2-(11) and 2-(12) of Decree no. 196/2003 (“Code for the protection of personal data”) as amended, Users - as Data Subjects - may exercise the rights recognised pursuant to and within the limits of Arts. 15-21 GDPR, including the right to ask the Data Controller for access to their personal data, for its rectification or erasure and for the restriction of data processing that relates to them, as well as to object to its processing and to request its portability.

Users are also entitled, at any time, to withdraw consents given for the processing of their personal data, without this prejudicing the lawfulness of processing based on said consents prior to their withdrawal. In particular, Users can change their preferences with regard the use of cookies by clicking here or on the widget button active on every web page.

Lastly, Users may lodge a complaint with a competent supervisory authority pursuant to art. 77(1) GDPR. In Italy the supervisory authority is the “Garante per la protezione dei dati personali” (Italian Data Protection Authority).

Users may exercise the above rights by sending a written communication to the registered office of the Data Controller, at the address given above, or to the following e-mail address privacy@coesia.com or by contacting the Data Protection Officer at the e-mail address above mentioned at par. 1.6 of this cookie policy.
